Any dispute arising out of or relating to these Terms or your use of the Services shall be resolved by binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association. The arbitration shall be conducted in San Francisco, California, and judgment on the arbitration award may be entered in any court having jurisdiction thereof.
You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. If for any reason a claim proceeds in court rather than in arbitration, you waive any right to a jury trial.
Notwithstanding the foregoing, you may bring an individual action in the small claims courts of the State of California if the claims qualify and so long as the matter remains in such court and advances only on an individual basis.
